General terms and conditions of business

Statutes of the (KinderSpassVerein Hamburg eV)

§ 1 Name, registered office, financial year

1.1 The association bears the name KSV Hamburg eV
(Children's Fun Club Hamburg eV)

1.2 It has its registered office in Hamburg and is entered in the register of associations at the District Court of Hamburg.

1.3 The financial year of the association is the calendar year.

§ 2 purpose of the association

2.1 The purpose of the association is to promote sport and intercultural exchange among children and young people. This is to be achieved through a wide range of offers, in which the focus is primarily on having fun doing sports.

2.2 In addition, the association would like to focus on youth work in the sense of free youth welfare. So-called open sports offers, mainly in social hotspots, are intended to offer children and young people a low-threshold, regular opportunity for extracurricular sporting activities without having to acquire a membership for this. In addition to participation and helping to shape extracurricular cultural education, these offers should also aim to improve social skills such as the ability to deal with conflict, communication, motivation and thus a sustainable socially integrative effect.

2.3 The association pursues exclusively and directly charitable purposes within the meaning of the section "Tax-privileged purposes" of the tax code. The association is selflessly active and does not primarily pursue its own economic purposes. Funds of the association may only be used for statutory purposes. The members do not receive payments from the association.

§ 3 Acquisition of Membership

3.1 Any natural (and legal) person can become a member of the association.

3.2 The Executive Board decides on the written application. In the case of minors, the consent of the legal representative is required.

§ 4 Termination of Membership

4.1 With the death of the member (in the case of legal entities: with their dissolution).

4.2 Membership ends automatically upon expiry of the campaign you have participated in.


§ 5 Admission or participation fees

Admission or participation fees are determined by the board of directors for the respective campaign.

§ 6 organs of the association

Organs of the association are:

6.1 – the General Assembly

6.2 - the Board of Directors

6.3 – Youth Assembly

6.4 – the Council of Elders

6.5 – Youth Committee

§ 7 General Assembly:

7.1 The General Assembly is to be convened annually by the 1st Chairman, subject to an invitation period of 2 weeks, by means of a personal invitation sent in a simple letter to the last known address of the members.

7.2 The general meeting takes place in the second half of the second year - every 2 years. The agenda set by the board of directors must be communicated with the invitation to the general assembly.

7.3 Motions for the general meeting must be received by the board at least 2 weeks before the day of the meeting in order to be included in the agenda.

7.4 The General Assembly has the following tasks:

- Approval of the minutes of the last general meeting,
- Report of the board of directors and cash report,
- Report of the cash auditor, discharge of the board,
-Elections and resolutions on existing applications.

7.5 All members of the association who have reached the age of 16 or 18 and have been a member of the association for at least 2/ 4/ 6 months are entitled to vote. The right to vote can only be exercised in person.

7.6 The General Assembly decides with the majority of the valid votes cast; Amendments to the articles of association and resolutions on the dissolution and/or merger of the association require a majority of ¾ of the association members present, resolutions on changes to the purpose of the association require a majority of 3/4 of all association members.

7.7 Each general meeting convened in accordance with the articles of association has a quorum regardless of the number of members present.

7.8 The management of the general meeting is the responsibility of the 1st chairman, if he is unable to do so, the 2nd chairman; the Executive Board is entitled to entrust a third person with the management of the meeting if necessary.

7.9 The resolutions of the general meeting are to be recorded in minutes, which are to be signed by the chairman of the meeting and the minute taker.

§ 8 Executive Board:

8.1 The board of the association consists of the 1st chairman, the
2. Chairperson (possibly other chairperson/treasurer etc.., youth director).
The association is represented in and out of court by two board members, of whom either the 1st or 2nd chairman must be.

8.2 The Board of Directors is elected by the General Assembly for a period of 3 years. He remains in office until a new election is held. If a member of the Executive Board resigns during the term of office, the Executive Board elects a substitute member for the remainder of the term of office of the retired Executive Board member.

§ 9 Club youth

9.1 The club youth is the youth organization of the club.

9.2 The club youth works according to a club youth regulation. This can be found in the appendix to the association's statutes and is part of the statutes.

9.3 The club's youth regulations are approved by the club's board of directors.

Section 10 Liability

10.1 With the acquisition of membership, each member waives all claims that may arise against the association if they suffer accidents or other disadvantages while participating in association operations within the meaning of § 2 of the statutes and/or in the performance of functions within the association . This waiver applies regardless of the legal grounds for which claims may be made. At the same time, it also extends to those persons and bodies who can otherwise independently derive claims from the accident.

10.2 This waiver does not apply if intentional action has led to the accident or disadvantage.

10.3 The member is obliged to inform himself about the scope and amount of the
informed about the insurance policies taken out and knows that they can also take out additional insurance at their own expense.

10.4 The members of the Executive Board are released from liability for simple negligence in the exercise of their management; this also applies to the monitoring of the activities of full-time managing directors and all other employees.

§ 11 cash auditor:
11.1 The cash auditors are elected by the general assembly for a period of 2 years. Re-election is permissible.

11.2 The cash auditors have the task of checking the management of the board and the use of the youth budget and the
Annual General Meeting to report.

§ 12 Dissolution of the association
If the association is dissolved or tax-privileged purposes no longer apply, the association's property goes to the community work St. Pauli - Süd eV (Hamburger Hochstraße 2, 20359 Hamburg), which must use it directly and exclusively for charitable purposes.

Club youth regulations of the KSV Hamburg eV
(Children's Fun Club Hamburg eV)

§ 1 Name and Membership
All club members up to the age of 18 and all employees who work regularly and directly in the club youth form the club youth of the KinderSpassVereins Hamburg.
The youngsters call themselves “Die SpassMacher”.

1. 1 Membership Fees
The membership fee for the use of all sports offers of our association
is €10 per month.
Members receive a 10% discount on all holiday soccer camps organized by the association
Offered during all Hamburg school holidays.

1. 2 Cancellation of Membership
The resignation of a member takes place by means of a written declaration to the executive board with a notice period of four weeks.

§ 2 Tasks and Goals
The club youth is active in youth politics and would like to support socially integrative processes.
She would like to motivate as many children and young people as possible to take part in regular sporting activities in the community of offers and to encourage/enable the participants to help shape things, to take responsibility and to treat people of different origins, cultures, religions and beliefs with respect.
As part of and in connection with the sporting activities, the club youth uses the experience space with the participants to improve social skills and thus promote/support personality development.

§ 3 Youth Assembly
The youth assembly is the supreme organ of the youth club. It meets at least once a year and elects the youth club committee.

This consists of:
– Club youth leader
– Club youth spokesman
– other employees

The members of the youth committee are elected for one year.
A simple majority of the votes cast is sufficient for election to the youth committee.
Club youth spokespersons must not have reached the age of 23 at the time of the election.

§ 4 Youth Committee
The club youth leader is a voting member on the club board and represents the club youth internally and externally.
He or she leads the association youth committee meetings, in which the youth work is planned and coordinated.

§ 5 Youth Fund
The club's youth is the responsible recipient of the grants for youth care measures. The youth fund is managed by the youth committee.

§ 6 Validity and amendment of the youth regulations
The youth regulations must be approved by a majority of two-thirds of the voting members present at the youth assembly and confirmed by a simple majority in the association board. This also applies to changes to the youth regulations.
The youth organization Changes to the youth regulations come into force with confirmation by the association's board of directors.

§ 7 Other Provisions
If the youth regulations do not contain any special regulations, the provisions of the association's statutes apply.
